Complaints Policy

We are committed to providing a first class service. However, if at any point you become unhappy about our service, our charges or the handling or storage of your personal data, we will do our best to resolve the problem. Making a complaint will not affect how we handle your matter. We will deal with your complaint promptly, fairly and you will not be charged for our work investigating it.

Initially you should immediately contact the person who is working on your matter to discuss your concerns. They will do their best to resolve any issues. If they do not do so or to your satisfaction then please contact John Moseley who is our designated complaints handler with your complaint either on his email: john@rjmoseley.com or by post at R J Moseley Solicitors Limited, Singleton Court Business Park, Wonastow Road, Monmouth, NP25 5JA.

Your complaint will be acknowledged within 3 working days. You will receive a written response providing reasons for the final decision on your complaint within 28 working days of the complaint being received. This is provided you have fully cooperated with any investigation required. If there is a delay, we will let you know why, and we will endeavour to conclude the investigation and make a decision as soon as is reasonably possible. At this stage we will also provide you with the details of an approved Alternative Dispute Resolution (ADR) body that is competent to deal with complaints about legal services. The matter can be referred to them if we both agree to use the scheme. We do not agree to use the scheme but are obliged to make you aware of an ADR approved body.

What to do if we cannot resolve your complaint

You can raise concerns about our behaviour or that we have not complied with the Solicitors Regulation Authority’s (“SRA”) Rules and Regulations to the SRA. This could be for things like dishonesty or treating you unfairly because of your age, a disability or other characteristic.

Provided you are eligible, The Legal Ombudsman (“LO”) may also help you if we are unable to resolve your complaint ourselves. If you are complaining as a business client, unless you are a “micro business” (as defined by the European Union), you may not be able to use the Legal Ombudsman scheme and should check the guidance on Legal Ombudsman’s website.

The LO will look at your complaint independently. Before accepting a complaint for investigation, the LO will check that you have tried to resolve your complaint with us first. The LO expects complaints to be made to them within one year of the date of the act or omission about which you are concerned or within one year of you realising there was a concern. You must refer your concerns to the LO within six months of our final response to you.

You have a right to challenge or complain about a bill. If your complaint is specifically about our bill, you have the right to object to it and apply for an assessment underpart III of the Solicitors Act 1974.

If all or part of a bill remains unpaid, we may be entitled to charge interest on the outstanding amount unless you have raised an unresolved bona fide query.
